the texture of the trees are in the house....why?

Have you tried resizing the mesh? Because if it's one huge square for the tree, this makes total sense. Try dividing it into little seperated squares .

the foliage of the tree is already divided into small squares...any other ideas?

You have a large billboard/quad/sprite somewhere on your map that's causing this. These will automatically orient themselves towards the camera and thus can intersect with other objects if placed in poor locations. It either needs to be scaled down like JayReezy said or removed entirely.
