We are using Model Shader 3.0
Besides ATI cards + OpenGL = a whole lot of dirty love.
They really have issues with it.

OpenGL and ATI isn't a problem whatsoever if done right. Also, based on the visual effects I've seen that you are using, you don't need more than shader model 2. What do you need more than 512 instructions for? Even if you are using vertex texture fetching for displacement on the ocean effect, there are cheaper/older alternatives to pushing your minimum requirement down (of which you actually said you were doing in your post -- unless you were only referring to LOD tessellation).
Considering Earth Special Forces's origins, I figured you'd even have fallback effects to the fixed function pipeline. One of the reasons I'd thought Earth Special Forces garnered a sizable fanbase to all gamer types was due to the "Counter Strike" low-system-requirement effect.

We already scrapped that when we went with SSE2 ^^;
Believe it or not, but people still don't have support for that.
Besides you know I'm the wrong person to talk to with in depth technical stuff.
